  • You must be at least 18 years old to use EldoSpaces.
  • You may not use the platform if you are barred from doing so under applicable laws.
  • Property owners and tenants must provide accurate information during registration and listing creation.

3. Account Creation and Management

  • Registration: To create an account, you must provide valid personal details (name, email, phone number).
  • Security: Protect your account credentials and notify us immediately if you suspect unauthorized access.
  • Profile Information: Ensure your profile details are accurate and up-to-date.
  • Deactivation: You can deactivate your account at any time through the settings page.

4. Listing Properties

  • Property Owners: Only verified property owners or authorized representatives may list properties on EldoSpaces.
  • Accuracy: Listings must include accurate details about the property (address, size, amenities, price, etc.).
  • Photos/Videos: High-quality media is required for all listings to ensure transparency.
  • Availability: Clearly indicate whether the property is available now or from a specific date.
  • Monetization: Premium services like featured listings, tenant screening, and virtual tours are available for a fee.

5. Tenant Services

  • Accompanied Viewings: Tenants may opt for accompanied viewings conducted by trained EldoSpaces field agents.
  • Tenant Screening: Property owners may request tenant background checks for an additional fee.
  • Secure Transactions: All payments and agreements are processed securely through our platform.
  • Cancellation Policy: Accompanied viewings canceled less than 24 hours in advance may incur a cancellation fee.

6. Payment Terms

  • Premium Services: Fees for premium services (e.g., featured listings, tenant screening) are clearly outlined during the transaction process.
  • Payment Methods: Payments can be made via MPESA, PayPal, or other supported methods.
  • Refunds: Refunds for premium services will be considered on a case-by-case basis and are subject to approval.
  • Late Payments: For rental agreements, late payments may result in penalties as defined by the landlord.

7. Intellectual Property

All content on the EldoSpaces platform, including text, images, and software, is protected by copyright and owned by EldoSpaces unless otherwise stated.

Users retain ownership of their submitted content (e.g., property photos, descriptions), but EldoSpaces reserves the right to use this content for promotional purposes.

8. Prohibited Activities

  • Fraudulent Behavior: Do not engage in fraudulent activities, such as submitting false property listings or impersonating others.
  • Spamming: Avoid spamming or sending unsolicited messages to other users.
  • Unauthorized Use: Do not use the platform for purposes other than those intended (e.g., commercial exploitation without permission).
  • Harassment: Treat other users respectfully and avoid harassment or abusive behavior.

9. Liability and Disclaimers

  • No Guarantees: While we strive to provide accurate and reliable information, EldoSpaces does not guarantee the accuracy of listings or outcomes of transactions.
  • Third-Party Services: We use third-party tools (e.g., Firebase, Cloudinary, MPESA API) to enhance functionality. These services are governed by their own terms and conditions.
  • Limitation of Liability: EldoSpaces is not liable for damages arising from the use of the platform, including but not limited to lost profits, data loss, or service interruptions.

10. Termination of Service

We reserve the right to terminate or suspend your account if you violate these terms.

Upon termination, you lose access to all features, and your listings will be removed from the platform.

11. Changes to Terms of Service

We may update these Terms of Service periodically to reflect changes in our practices or legal requirements.

Any updates will be posted here, and we'll notify you via email or in-app alerts.

12. Governing Law

These Terms of Service are governed by the laws of Kenya.

Any disputes arising from the use of EldoSpaces will be resolved in accordance with Kenyan law.
